These terms and conditions apply to the provision of the services detailed in our quotation by NiceSmile Limited(we or us) to the person buying the services (you). If you do not agree with the terms and conditions below, please do not attempt to use any of the tools available on our website(s) or servers. You agree to read the terms and conditions carefully before using Illuumin services. Continued use of our services indicates your acceptance of the terms and conditions.

General
1. All of these terms and conditions apply to the supply of any services unless we specify otherwise.
2. The description of the services on our website does not constitute a contractual offer to sell the services. When an order has been submitted on the website, we can reject it for any reason, although we will try to tell you the reason without delay.

Intellectual property and acceptable use
1. By having captured the images does not grant NiceSmile the right to use such images to share, display or use for marketing or promotion without written consent of parent/guardian.
2. All photos displayed on the website, unless uploaded by the users, is the property of NiceSmile, our affiliates or other relevant third parties. In these terms and conditions, content means any text, graphics, images, video, page layout, underlying code and any other form of information capable of being stored in a computer that appears on or forms part of this website. By continuing to use the website you acknowledge that such content is protected by copyright, trademarks, database rights and other intellectual property rights. Nothing on this site shall be construed as granting, by implication, estoppel, or otherwise, any license or right to use any trademark, logo or service mark displayed on the site without the owner’s prior written permission.

3. You acknowledge that you are responsible for any content you may submit via the website, including the legality, reliability, appropriateness, originality and copyright of any such content. You may not upload to, distribute, or otherwise publish through the website any content that is (i) confidential, proprietary, false, fraudulent, libellous, defamatory, obscene, threatening, invasive of privacy or publicity rights, infringing on intellectual property rights, abusive, illegal or otherwise objectionable, (ii) may constitute or encourage a criminal offence, violate the rights of any party or otherwise give rise to liability or violate any law; or (iii) may contain software viruses, political campaigning, chain letters, mass mailings, or any form of “spam.” You may not use a false email address or other identifying information, impersonate any person or entity or otherwise mislead as to the origin of any content.
4. You represent and warrant that you own or otherwise control all the rights to the content you post; that the content is accurate; that use of the content you supply does not violate any provision of these terms and conditions and will not cause injury to any person; and that you will indemnify NiceSmile for all claims resulting from content that you supply.

Turnaround Times
1. Retail Orders – orders will be completed within four working days. Working days are defined as Monday – Friday. Customer services is available Monday – Friday 09:00-17:00 except for UK Bank Holidays.

2. You will be notified, within a reasonable time frame, of any holiday dates, planned technical maintenance, or other foreseeable actions that may affect your turnaround time.
3. Turnaround times begin once the whole order has been received and downloaded.
4. Any submissions for revisions are prioritised. Where this is due to no fault of our own, we will accommodate urgency where possible.

DOWNLOADS POLICY
Once your order and payment have been processed, your image(s) will be available for you to download on your account.
All downloads are high-resolution images that allow you to print up to an 8"x12" print.
We recommend download files are saved to the parent/guardian's own device.
Our system registers when the photographs have been downloaded, after which, they will not be eligible for a return or refund.
If you wish to cancel your order for downloads and our system shows you have not yet downloaded the images, we offer an exchange or store credit for future purchases.

UK Standard delivery (3-7 working days)
Special or recorded delivery – If you wish for your order to be sent with either of these delivery methods please contact the office on 02071838683 or info@nicesmile.co.uk or use a chat facility on www.nicesmile.co.uk. Please note there will be a charge for this service

Data Protection
1. The use of our services is governed by our privacy policy, which can be found at www.nicesmile.co.uk Each party shall comply with the Data Protection Laws (including all applicable data protection and privacy legislation in force from time to time in the UK including the General Data Protection Regulation ((EU) 2016/679), the Data Protection Act 2018; the Privacy and Electronic communications Directive 2002/58/EC, as updated, and the Privacy and Electronic Communications Regulations 2003 (SI 2003/ 2426) as amended) with respect to the processing of the Personal Data (as defined in the Data Protection Legislation).
2. We shall ensure that persons authorised to process the Personal Data have committed themselves to confidentiality or are under an appropriate statutory obligation of confidentiality.

Governing law, jurisdiction and complaints
1. The contract (including any non-contractual matters) is governed by the law of England and Wales. Disputes can be submitted to the jurisdiction of the courts of England and Wales, or where the customer lives in Scotland or Northern Ireland, in the courts of respectively Scotland or Northern Ireland.
